- ACCEPTANCE OF TERMS
By purchasing, accessing, or using any services provided by TheBRHub (“Company,” “we,” “us,” or “our”), including but not limited to EngageCore CRM & Marketing Automation platform (“Service” or “Platform”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use our Services. - SERVICE DESCRIPTION
EngageCore is a Software-as-a-Service (SaaS) platform providing CRM, marketing automation, lead management, website hosting, appointment scheduling, and related business growth tools. The Platform includes multiple products and pricing tiers designed for local service businesses, entrepreneurs, and agencies.
Service Components Include:
CRM and lead management system
Marketing automation tools and workflows
Website hosting and optimization
Online appointment scheduling
AI-powered chat and phone systems
Review management platform
Analytics and reporting dashboard
Email and SMS marketing capabilities - SUBSCRIPTION TERMS
3.1 Billing Cycles
Services are offered on a subscription basis with monthly or annual billing cycles. You will be charged the applicable subscription fee at the beginning of each billing period.
3.2 Pricing and Plans
Current pricing is available at https://thebrhub.com/engagecore-crm-marketing-automation/. We reserve the right to modify pricing with 30 days’ written notice to existing customers. Price changes will take effect at your next billing cycle.
3.3 Auto-Renewal
Your subscription will automatically renew for successive periods equal to your original subscription term unless you cancel before the renewal date. You are responsible for canceling your subscription if you do not wish to continue. - PAYMENT TERMS
4.1 Payment Authorization
For Services purchased by credit card or other accepted payment methods, you expressly agree that TheBRHub is permitted to invoice and charge your payment account for:
Applicable subscription fees
Setup fees (if applicable)
Usage-based charges
Applicable taxes
Any other charges incurred in connection with your use of the Service
4.2 Payment Processing
Fees, taxes, and related charges will be billed to the payment method you provide when payment is due. You agree to allow TheBRHub, our affiliates, or service providers to process and store your payment information securely.
4.3 Failed Payments
If payment is not received or cannot be charged to your payment account for any reason in advance of the applicable subscription term, TheBRHub reserves the right to:
Suspend your access to the Service immediately
Terminate your account and this Agreement at our sole discretion
Charge applicable late fees or service restoration fees
4.4 Refunds
All subscription fees are non-refundable except as required by law or as specifically stated in these Terms. Setup fees and one-time charges are non-refundable under all circumstances. - ACCOUNT RESPONSIBILITIES
5.1 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
5.2 Accurate Information
You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy.
5.3 Compliance
You agree to use the Service in compliance with all applicable laws and regulations, including but not limited to anti-spam laws (CAN-SPAM, GDPR, CCPA) and telecommunications regulations. - ACCEPTABLE USE POLICY
You may not use the Service to:
Send unsolicited commercial emails or spam
Violate any applicable laws or regulations
Infringe on intellectual property rights
Transmit malicious code or harmful content
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Service’s operation - DATA AND PRIVACY
7.1 Data Ownership
You retain ownership of all data you input into the Platform. We do not claim ownership of your customer data, content, or business information.
7.2 Data Security
We implement industry-standard security measures to protect your data. However, no system is 100% secure, and you acknowledge the inherent risks of data transmission over the internet.
7.3 Data Backup
While we maintain regular backups, you are responsible for maintaining your own backup copies of critical data. - SERVICE AVAILABILITY
8.1 Uptime Commitment
We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Planned maintenance will be scheduled during off-peak hours when possible.
8.2 Support
Support is provided during business hours (Monday-Friday, 9 AM – 5 PM PST) via email and support ticket system. Response times vary based on your subscription level. - INTELLECTUAL PROPERTY
The Service, including all software, content, trademarks, and intellectual property, remains the exclusive property of TheBRHub. You receive a limited, non-exclusive, non-transferable license to use the Service during your subscription term. - LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEBRHUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM. - TERMINATION
11.1 Termination by You
You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellation takes effect at the end of your current billing period.
11.2 Termination by Us
We may suspend or terminate your account immediately for:
Violation of these Terms
Non-payment of fees
Illegal or harmful use of the Service
At our discretion with 30 days’ notice for any other reason
11.3 Effect of Termination
Upon termination, your access to the Service will cease, and we may delete your data after a reasonable retention period. - MODIFICATIONS
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of the Service after modifications constitutes acceptance of the updated Terms. - GOVERNING LAW
