By purchasing, accessing, or using any services provided by TheBRHub ("Company," "we," "us," or "our"), including but not limited to EngageCore CRM & Marketing Automation platform ("Service" or "Platform"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
These Terms, published at thebrhub.com/terms-of-service, are the sole and governing terms for the Services. Any previously published version, including any document titled "Terms and Conditions," is superseded by this document as of the Last Updated date above.
EngageCore is a Software-as-a-Service (SaaS) platform providing CRM, marketing automation, lead management, website hosting, appointment scheduling, and related business growth tools. The Platform includes multiple products and pricing tiers designed for local service businesses, entrepreneurs, and agencies.
Service Components Include:
Services are offered on a subscription basis with monthly or annual billing cycles. You will be charged the applicable subscription fee at the beginning of each billing period.
Current pricing is available at thebrhub.com/engagecore. We reserve the right to modify pricing with 30 days' written notice to existing customers. Price changes take effect at your next billing cycle. If you do not agree to a price change, you may cancel before it takes effect as described in Section 11.1, and the change will not be applied to you.
Your subscription automatically renews for successive periods equal to your original subscription term unless you cancel before the renewal date. Monthly subscriptions renew every month. Annual subscriptions renew every twelve (12) months. Renewal charges are applied to the payment method on file at the then-current rate for your plan. You may cancel at any time as described in Section 11.1, and cancellation prevents all further renewal charges.
Before we collect your billing information and before any charge is applied, we disclose the material terms of your subscription, including the price, the billing frequency, the length of any free trial, the fact that the subscription renews automatically until you cancel, and how to cancel. You must affirmatively consent to those terms at checkout in order to complete your purchase. We retain a record of that consent for at least three (3) years, or one (1) year after the subscription terminates, whichever period is longer.
We send a reminder to the email address on your account before a free trial converts to a paid subscription, and at least once each year before an annual subscription renews. Each reminder identifies the subscription, the amount and frequency of the charge, and the means to cancel.
For Services purchased by credit card or other accepted payment methods, you expressly agree that TheBRHub is permitted to invoice and charge your payment account for:
Fees, taxes, and related charges will be billed to the payment method you provide when payment is due. You agree to allow TheBRHub, our affiliates, or service providers to process and store your payment information securely.
If payment is not received or cannot be charged to your payment account for any reason in advance of the applicable subscription term, TheBRHub reserves the right to:
4.4.1 Annual Plan Money-Back Guarantee. If you purchase an annual subscription, you may request a full refund of the initial annual subscription fee by contacting support within thirty (30) days of the date that fee is first charged. Refunds under this section are issued to the original payment method and terminate the subscription and all access to the Service upon issuance. This guarantee applies only to your first annual subscription term for a given plan and does not apply to renewal terms.
4.4.2 All Other Subscription Fees. Except as stated in Section 4.4.1, all subscription fees are non-refundable, including monthly subscription fees and annual fees charged more than thirty (30) days before a refund request. Cancellation stops future renewal charges. It does not entitle you to a refund or proration of the term you have already paid for, and your access continues through the end of that term.
4.4.3 Usage-Based and One-Time Charges. Usage-based charges, including email sends, SMS messages, and AI feature usage, are non-refundable. Setup fees and other one-time charges are non-refundable under all circumstances.
4.4.4 Statutory Rights. Nothing in this section limits any refund or cancellation right you have under applicable law.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.
You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy.
You agree to use the Service in compliance with all applicable laws and regulations, including but not limited to anti-spam laws (CAN-SPAM, GDPR, CCPA) and telecommunications regulations.
You may not use the Service to:
You retain ownership of all data you input into the Platform. We do not claim ownership of your customer data, content, or business information.
We implement industry-standard security measures to protect your data. However, no system is 100% secure, and you acknowledge the inherent risks of data transmission over the internet.
While we maintain regular backups, you are responsible for maintaining your own backup copies of critical data.
We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Planned maintenance will be scheduled during off-peak hours when possible.
Support is provided during business hours (Monday–Friday, 9 AM – 5 PM Pacific Time) via email and support ticket system. Response times vary based on your subscription level.
The Service, including all software, content, trademarks, and intellectual property, remains the exclusive property of TheBRHub. You receive a limited, non-exclusive, non-transferable license to use the Service during your subscription term.
To the maximum extent permitted by law, TheBRHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption, arising from your use of the Service.
Our total liability to you for any claims related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
You may cancel your subscription at any time from your account dashboard, or by contacting support at support.thebrhub.com. If you subscribed online, you may cancel online, without contacting us by phone or speaking to a representative. Cancellation takes effect at the end of your current billing period, and you retain access to the Service through the end of the period you have already paid for. Except as provided in Section 4.4.1, cancellation does not entitle you to a refund or proration of the current term.
We may suspend or terminate your account immediately for:
Upon termination, your access to the Service will cease, and we may delete your data after a reasonable retention period.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of the Service after modifications constitutes acceptance of the updated Terms.
These Terms are governed by the laws of California, United States. Any disputes will be resolved in the courts of San Diego County, California.
